In this case, there are two notices of motion. While hearing motion no. 3362/19 for grant of ad-interim relief this Court had granted ad-interim relief considering that the representation by the plaintiff was pending before defendant. At the same time it was observed that the terrace sought to be protected was a recent development. Thus the ad-interim relief was granted only on the ground of pendency of representation.
Today, while hearing the notice of motion no. 3351/19 this Court has refused the ad-interim relief. The refusal of ad-interim relief is refusal of injunction sought to restrain defendant from implementing the notice and the order deciding the representation of the plaintiff. Thus, the ad-interim relief granted in NM no. 3362/19 stands vacated in the light of order passed in NM no. 3351/19.
Once, the ad-interim relief is refused on merits, no question arises to grant any protection further. Hence the application is rejected.

The following Order is passed on NM No. 258/2022:
01. Heard both the sides. Having considered their submissions, at the outset, it is clear that till date, the plaintiff failed to serve the copy of amended plaint to newly added defendant No. 2 in view of Order VII Rule 9 of the CPC and therefore, this plaint is liable to be rejected under Order VII Rule 11 (f) of the Code. However, prior to passing such Order, which is having far reaching consequences, the plaintiff is directed to comply with the same positively till the next date. Coming to the objection on this plaint in view of Section 149 of the MRTP Act, it is notable that the suit is filed in the year 2019 and it is registered long back. In the meantime, even the NM, filed by the plaintiff, was decided and defendant No. 2 is also added as party to this suit as per Order on Ch/s No. 1833/2019, passed on dtd. 20.12.2019. On this background, it appears that the requisite permission U/sec. 149 of the MRTP Act is impliedly granted to the plaintiff. Lastly, as regards non-compliance of the Order on Ch/s., it seems that recently, the plaintiff carried such amendment in plaint and is awaited to serve copy of amended plaint on defendant No. 2. Consequently, he is directed to comply with the provisions of Order VII Rule 9 of the CPC till the next date. In default, the plaint would stand rejected Under Order VII, Rule 11 (f) of the Code. In view of these terms, NM No. 258 of 2022 is partly allowed. The parties to take note.
