Heard Ld. counsel for plaintiff. He submitted application for
withdrawal of the suit in view of out of court settlement between
plaintiff and defendant no. 1 and 2, who have paid the due amount to
the plaintiff. Hence, plaintiff is withdrawing the suit against
defendant no. 1 and 2 and do not want to proceed against defendant
no.3.
Application for withdrawal. O-Order passed on it. Allowed to
withdraw the suit unconditionally against defendant no. 1 to 3 as
prayed. Court fee shall be refunded to the plaintiff as per rules.
Suit disposed as withdrawn. Notice of Motion or Chamber
Summons, if any, disposed of as infructuous. Suit be register for
statistical purpose.
