It is submitted that page no.16 and 17 of the plaint shows that Defendants have deleted Plaintiff\''s name from the list of heirs of deceased father of Plaintiff.  Further, Plaintiff\''s advocate referred page no.48 and pointed out that even after death of father of Plaintiff which took place in the year 2013 amounts from the bank account of father of Plaintiff are withdrawn by Defendants by selling the shares of the deceased father.
At this juncture Defendants advocate submitted that shares which were sold were purchased in the names of Defendants as second holder and the Defendant no.1 is the second holder of the bank account which is referred at page no.48 of the plaint.  Court has directed Defendant to produce the passbook of the account of father of Plaintiff to show that Defendant no.1 is operating said account as joint account holder.

By the C/S the plaintiff seeks to delete the name of defendant no. 1 since she died on 29-07-2021 leaving behind the defendants no. 2 and 3 as her legal representative. The C/S is supported with death certificate issued by Kolhapur Municiple Corporation stating the date of death of Shanta Kamlakar Sakhardande as 29-07-2021 and also by the plaintiffs affidavit in support.
