F.R.S.R. following order has passed-
ORDER
Review Petition no.211 of 2019 stands dismissed.
Plaintiff submitted that already he has withdrawn review petition which is at Exh.51 however record shows that it is not disposed off hence court has directed to mention Plaintiff on Exh.51 that he is intending to withdraw said review petition. Accordingly, Plaintiff made endorsement on review petition. On perusal of roznama dated 16/1/19 it is noticed that my learned predecessor has passed order that Exh.51 is disposed off as withdrawn however as today Plaintiff has mentioned on Exh.51 that he has withdrawn it, considering the order dated 16/01/2019 passed by my learned predecessor said Exh.51 is already disposed off.
Advocate for Defendant no.1 submitted that copy of Exh.58 is not served upon Defendant no.1. Plaintiff submitted that he has the acknowledgment showing that copy of Exh.58 is sered upon Defendant no.1. It seems that advocate for Defendant no.1 is not having copy of Exh.58 hence Plaintiff is directed to give one more copy of Exh.58 to Defendant no.1 so that he will be able to reply Exh.58 however it is made clear that, Defendant no.1 should not take out contempt petition against Plaintiff for disobedience of this order because Plaintiff is having the acknowledgment of its service. It is made clear that, if Plaintiff will not provide copy of Exh.58, said Defendant may get certified copy from the court.
Plaintiff submitted that he will argue application Exh.52 and 53 on next date. Plaintiff further submitted that considering his age he may be permitted to argue one review petition at one time.
Case is adjourned to 26/03/2020 for hearing on Exh.52,53 and say to Exh.58.
