COMMON ORDER ON NOTICE OF MOTION BEARING NO. 3247/2019 AND 3127/2018.
The Notice of Motions was fixed for hearing on the present date. However, the plaintiff as well as his learned advocate have chosen to remain absent. Despite specific and precise directions issued by this Court, neither the plaintiff nor his advocate remained present to proceed with the matter. There is no separate application tendered on record seeking adjournment. This conduct of the plaintiff shows that now he has lost his interest in the suit as well as Notice of motion. Therefore there is no reason to postpone instant matter on next date for the same purpose. It is only due to absence of the plaintiff and for want of taking effective steps the Notice of motion could not proceed ahead and therefore considering the age of the lis, this Court is constrained to pass dismissal order. Ergo the Notice of motion bearing no. NM 3247/2019 and 3127/2018 are dismissed for default and disposed off accordingly.
