ORDER
The learned Advocate for the defendant today produced
copy of order dated 06.12.2021 passed in Writ Petition No.8393/2021.
The order dated 31.03.2021 in Notice of Motion No.877/2021,
dismissing the defendant's motion for relief of return of plaint under
Order VII Rule 10 of CPC was challenged by the defendant in the said
Writ Petition No.8393/2021.
2. The aforesaid writ petition has been allowed and plaintiff

Comm.SU No.16519
has been permitted to present the plaint to the appropriate Court as the
dispute is not commercial dispute. Hence, I pass the following order.
ORDER
1. In compliance to the order dated 06.12.2021 passed in Writ
Petition No.8393/2021, plaint be returned to the plaintiff to
present it before appropriate Court.
2. The Registrar (Civil) to comply with the required procedure in
view of the order in Writ Petition No.8393/2021.
3. The plaintiff to comply with the procedural aspect for return
of plaint.
4. Case be removed from board of this Court as return of plaint.
