Plaintiffs no. 2 and 3 present along with advocate.
Adv. R. M. Mulla for plaintiffs present and filed application for
withdrawal of suit.
Application filed by Ld. counsel for plaintiffs for withdrawal of
suit.
None present for defendant.
It is submitted by Ld. counsel for plaintiffs that the plaintiff no. 1
has died on 02.02.2017. Thereafter, the LR's of plaintiff no. 1
along with plaintiff no. 2 and 3 and defendants have settled the
dispute out of court as per MOU dated 14.02.2019 Noterized
before the Notary public.
Therefore, the plaintiff no. 2 and 3 have decided to withdraw the
suit and the LR's of plaintiff no. 1 would be withdrawing the
Chamber summons, taken out for bringing them on record. The
LR's of plaintiff no. 1 are also present before the court and they
also admit the fact of compromise.
In view of the above, plaintiffs no. 2 and 3 along with LR's of
plaintiff no. 1 are allowed to withdraw the suit unconditionally as
prayed in Ex-3 along with CS no. 1545/19 and 1551/19 for
condonation of delay and bringing LR's of plaintiff no. 1 on
record.
Suit along with CS no. 1545/19 and 1551/19 are disposed of as
withdrawn. Court fees be refunded as per rules.
