(C.R.No.06) O R D E R This chamber summons is taken out by the applicant for making amendment in the plaint. The defendant Municipal Corporation resisted this chamber summons by filing reply thereon. Read the present chamber summons, reply of the defendant thereon. Heard both the learned counsels on behalf of both the sides at length. Perused the record. 2. The learned counsel on behalf of applicant has submitted that applicant wants to add him as defendant. In support of contentions, the applicant i.e. proposed defendant no.4 Shantilal Dhanji Dedhia has filed his affidavit. The plaintiff has no objection. The learned counsels on -- 1 of 3 -- 2 behalf of the defendant nos.1and 2 have raised objection stating that the applicant is not proper and necessary party. 3. After hearing the arguments advanced on behalf of both the sides at length, though the defendant Municipal Corporation have raised objection for allowing the chamber summons of the the applicant, but the learned counsel on behalf of the plaintiff has no objection for adding to the applicant as defendant. Therefore, I inclined to allow this chamber summons. ORDER 1. Chamber summons no.1534/19 is hereby allowed as prayed for. 2. The plaintiff and his advocate are hereby directed to carry out proposed amendment within stipulated period. 3. Chamber summons no. 1534/19 is disposed off accordingly. Date : 19.10.2019.
