On last date the plaintiff has filed documents alongwith pursis at
Exh.35. Defendant No. 3 (e) has filed documents alongwith pursis at
Exh.36, which was wrongly mentioned as for defendant No. 1. The
plaintiff and defendant No. 3 (e) to file reply on Exh. 36 and 35
respectively. In view of submission of Learned Advocate for
defendant No. 3 (e) and affidavit of service at Exh.33, pursis at
Exh.32 the Counter Claim is proceeded ex-parte against defendant
Nos. 11 and 12.
Advocate Jitesh Agarwal for defendant Nos. 8 (a), 8 (b) and 7 (b)
and 7 (c) present and filed Vakalatnama at Exh.37 and Exh.38.
Defendant No. 3 (e) has filed reply on Notice of Motion No.
5308/2025. He has strong objection to condone the delay. Lastly
both parties agreed to allow the Notice of Motion on costs. Hence
Notice of Motion No. 5308/2025 stands allowed subject to costs of
Rs. 1000/- payable to defendant No. 3 (e) on or before next date.
Accordingly additional Written Statement of the plaintiff is taken on
record subject to payment of costs. It is marked at Exh.3/1.
Defendant No. 3 (e) has filed reply on Notice of Motion No.
3192/2019. He has strong objection to condone the delay. Lastly
both parties agreed to allow the Notice of Motion on costs. Hence
Notice of Motion No. 3192/2019 stands allowed subject to costs of
Rs. 1000/- payable to defendant No. 3 (e) on or before next date.
Accordingly Defendant No. 1 to file Written Statement to the
Counter Claim on next date. Failure of which necessary order will be
passed.

appearance).
By consent of both parties, matter stands adjourned for NM
argument to 05-12-2025.
