Adv. Nandini Joshi for plaintiff submitted that matter
is settled between the parties and consent terms are already
filed before Hon'ble High Court in suit no. 347/2017. She
also pointed out details of the consent terms (xerox copy)
annexed with the application. Role of defendant no. 1 is
restricted to dealing with the demat account of defendant
no. 2 and his sister Sita Pralhad Mehta (since deceased). As
the plaintiff is volunterily withdrawing the suit in view of
settlement before Hon'ble High Court in suit no. 347/17,
application can be allowed. Hence, I passed the following
order
Order
1. Application Exh.6 is allowed.
2. Suit No. 1529/16 is disposed off as withdrawn.
3.Court fees be refunded to the Plaintiff as per rules and
Refund Certificate be issued accordingly.
4. Parties shall bear their own costs.
5. NM No. 3148/19 is disposed of having become
infractuous due to disposal of the main matter.
6. Proceeding are closed.
