ORDER
1. The plaintiff filed instant Chamber Summons for deleting the
name of defendant no. 1 as he has been expired on 22.11.2017.
2. It is contended by the plaintiff that defendant no. 1 expired
on 22.11.2017 and her legal heirs are already on record i.e.
defendant no. 2 to 5. Hence, suit does not abated. Hence,
plaintiff seeking permission to carry out necessary amendment.

3. The Chamber Summons is formally opposed by the
defendant. The defendant no. 1 expired on 22.11.2017. However,
defendant no. 2 to 5 are legal respresentative who are on record.
Hence, in my view, suit does not abated. Hence, necessary
amendment needs to be carry out in the interest of justice. Thus, I
proceed to pass the following order :
ORDER
1. Chamber summons No.1520 of 2019 is made absolute in
terms of prayer clause(a) and (b).
2. Plaintiff to carryout amendment as per schedule within 14
days from the date of order.
3. Chamber summons No.1520 of 2019 is disposed off
accordingly.
