By this application the plaintiff has prayed for permission
to bring legal heirs of deceased defendant on record.
2. Heard learned advocate for the plaintiff. Read the
applications Exhibit 4 and Exhibit 3. The plaintiff has also prayed that
delay if any, shall be condoned in view of directions of Hon'ble Supreme
Court in SuoMotu Writ Petition No. 3 of 2020. It is the contention of
the plaintiff that the defendant has expired on 06.02.2020. In view of
directions of Hon'ble Supreme Court in SuoMotu Writ Petition No. 3
of 2020, there is no question of delay. Hence, there is no requirement
to issue notices to the legal heirs. Hence, I pass the following order :

ORDER
1. Application Exhibit 4 is allowed.
2. The plaintiff is allowed to bring legal heirs of deceased
defendant on record.
3. The plaintiff to carry out the amendment and serve the suit
summons on the legal heirs of deceased defendant.
