Gohil has endorsed on Misc.application that the plaintiff has claim of Rs.84,400/- as on today and has no objection if the excess amount is refunded to the Defendant. Defendant has also endorsed on the Misc.application that in view of the statement made by Shri. Gohil, this Misc.application be disposed off. In the Misc.application it has been prayed that an excess amount of Rs.1,26,498/- be paid over to defendant by payee cheque for NEFT, which is lying in the Office of Sheriff of Mumbai. Upon hearing the parties present today and upon hearing Shri.B.S.Patil, advocate for the defendant, the said prayed is granted accordingly and Misc.application stands disposed off. Parties and authorities to act on copy of this order duly authenticated by the Sheristedar of this Court. Later on, Shri. B.S.Patil appeared and pointed out that there is bonafied error in respect of excess amount to be paid over to the defendant and an amount to be paid over to the plaintiff towards satisfaction of the decree and prayed that, he may be allowed to correct the prayer clause mentioning the amount of Rs. 1,01,100/- to be paid over to the defendant and the amount of Rs.84,400/- to be paid over to the plaintiff. Considering his prayer Shri. Patil is allowed to correct the prayer clause accordingly and the same has been corrected by Shri. Patil. In view of this, the excess amount of Rs.1,26,498/- as mentioned in the order be read as 1,01,100/-.
