He orally opposed the chamber summons. No argument of
the plaintiff. KB for order. LO at 04.50 pm Adv.Anil
Jadhav h/f. Adv.V.N.Naik for plaintiff present. ORDER IN
CH/S. NO.1506/2019 Read the chamber summons,
affidavit and annexures. The advocate for deft.orally
opposed the chamber summons. The plaintiff by this
chamber summons requested for permission to insert
proposed para No.24A in the plaint which is in respect of
valuation and payment of Court fees. The Ld.Adv.for the
deft. opposed the calculations made by the plaintiff in
para No.3 of the affidavit. He also disputed the
endorsement on the challan as to payment of Court fee
which reads as ‘not verified with RBI’. In short he
disputed about payment of Court fee. Said endorsement
can be verified by calling report of the concerned section
with respect of payment of Court fee. The amendment
prayed is technical one. It is required to be allowed.
Hence, I pass the following order. ORDER 1.Chamber
Summons No.1506/2019 is allowed in terms of prayer
clause a. 2. The plaintiff to carry out the amendment
within 14 days. 3. The report of Registrar (Civil) is called
in respect of payment of Court fee by verification of the
endorsement in challan attached at page No.10 and 11 of
the chamber summons. 4. Chamber Summons
No.1506/2019 is disposed of accordingly.
