This is the CS taken by the plaintiff to delete the name of defendant No.7 on record and to add her Legal heir as a party of this suit. After perusal of the record it shows that the proposed LR of defendant No.7 Kailash Baban Nigut had filed CS No.31/25 to add him as a party of the suit in place of defendant No.7 as her legal heir. However it is subsequently not pressed by him. It is admitted fact on record that the defendant No.7 is expired and Kailash Baban Nigut is her sole Legal heir. Hence if the CS will allowed it will not cause any prejudice to the either party nor it will affect the merit of the case. Hence following order is passed.
ORDER
1. CS No.1340/2026 is allowed.
2. Plaintiff is directed to carry out necessary amendment as prayed on or before next date.
3. Cost in main cause.
