Adv. for Plaintiff present and strongly opposed the draft NM filed by defendant no.1. It is contended that notice of motion filed to set aside no say order is not maintainable as there is no provision. It is mentioned that the no say order could have challenged before appropriate court and this court cannot set aside the same.
Adv. for defendant no.1 is present when called. In the notice of motion it is mentioned that matter was listed on 21.08.2025 for filing say, the document filed by plaintiff. On that day, Adv. appearing for defendant no.1 was before Honorable High Court and could not attend the court, and the no say order is passed. It is submitted that the defendant no.1 is interested to proceed with the matter and if opportunity to give say is not granted, it will cause grave prejudice, loss and harm hence, prayed to set aside the order.
I have gone through the NM and roznama. It reflects that matter was placed on 20.06.2025 and the copy of evidence and document were not served on the defendant no.1 hence, plaintiff made a statement that the copies of evidence and document will be served and accordingly matter was adjourned to 21.07.2025 for admission and denial and thereafter on 21.08.2025, no say order was passed.
