ORDER
1. The plaintiff has filed instant Chamber Summons for
discharging Court Commissioner and to record further evidence of
the plaintiff in the Court.
2. The Chamber Summons is opposed by the defendant by
filing say. Heard Ld. Advocate for the plaintiff. The defendant is
absent, hence, the pleadings of the defendant is considered as
reply.

3. I have perused the Commissioner Report namely Pravin G.
Sawant. In which he has expressed his unwillingness to act as
Commissioner. Advocate for the plaintiff made a statement that
both the sides have paid arrears of Commission Fees. Thus, for the
reasons stated in the application, the Commissioner Mr. Pravin G.
Sawant is discharged. The defendant to crossexamined the PW.1
on next date. The evidence recorded by the Commissioner shall be
taken as it is, and it will be continue and crossexamination of
PW.1 shall be continued from there. In my view, the Chamber
Summons is needs to be allowed. Thus, I proceed to pass the
following order :
ORDER
1. Chamber Summons No. 1473 of 2019 is made absolute in
terms of prayer clause (a) and (c).
2. Chamber Summons No. 1473 of 2019 is disposed off
accordingly.
