ORDER
LD advocate for plaintiff submits that the alternative occomodation was provided to the plaintiff in one Hotel by defendant no.4 who is developer. Now due to Covid-19 Pandemic plaintiff is not allowed to occupy the Hotel also. Respondent No.3 MHADA is present through advocate Mr.Kandekar. Ld advocate for MHADA submits that NOC is issued to the builder. In the circumstances, considering the pandemic situation Hotel cannot be a safe alternative accommodation. Today, none present on behalf of defendant no.4 developer. Considering the urgency in the matter is lastly adjourned to 25.01.2022. Plaintiff is directed to serve defendant no.4 on the same date. If inspite of service defendant no.4 fails to appear before the Court on 25.01.2022, necessary orders will be passed. By the time defendant no.3 MHADA is directed to report to the Court as to whether alternative accommodation was offered by the developer defendant no.4 and whether it is lawful on the part of developer to offered alternate accommodation in the Hotel. ORDER
Ld. advocate for the defendant No.4 submits that plaintiffs are held entitled for one commercial and one residential premises by MHADA.  The ld. advocate for MHADA also confirms the said fact.
Ld. advocate for defendant No.4 further submits that he is ready to pay monthly rent/compensation from the date of eviction till date at the rate of Rs.12,000/- per month for commercial premises and Rs.15,000/- per month for residential premises.  He is ready to pay the amount by way of Demand Draft and further submits that the plaintiffs shall execute the permanent alternate accommodation agreement against the said payment for one commercial and one residential premises.
Ld. advocate for the plaintiff submits that for commercial premises the rent paid by the defendant No.4 to other tenants is Rs.22,000/- per month and for residential premises at Rs.16,000/- per month.  Ld. advocate for the plaintiff further submits that his clients are facing starvation and currently residing in the house of their relatives.
Today, the ld. advocate for MHADA has filed report in pursuance to the order dated 14.01.2022 which discloses that after eviction of the plaintiff from the old premises temporary alternate accommodation was allotted at Magathane Borivali. However, admittedly, the plaintiffs have not occupied that premises.
Another important fact is that roznama dated 11.11.2020 shows that the Chamber Summons of the plaintiffs bearing No.540 of 2020 was dismissed with costs of Rs.10,000/-.  It is further observed by my ld. predecessor that in case, the plaintiffs want to further proceed in the matter, they shall deposit the cost under protest.
Admittedly, instead of depositing the cost under protest, the plaintiffs have preferred a Notice of Motion for recalling the order.
In the above circumstance, the ld. advocate for the plaintiffs submits that he will take instruction from his client whether they are ready to accept the amount of transit rent/compensation as offered by the defendant No.4 for one commercial and one residential premises by keeping alive all their rights to claim compensation at higher rate and rent/compensation for remaining three premises and submit their willingness to execute the permanent alternative accommodation agreement for one commercial and one residential premises on the next date.
It is hereby made clear that unless the plaintiffs deposit the amount of Rs.10,000/- under protest on or before next date, no further proceedings will be conducted as ordered by my ld. predecessor on 11.11.2020
