The plaintiff requested permission to lead secondary evidence of the cheque bearing no. 052923 drawn on state bank of India dated 22.06.2018 of Rs. 1,00,00 and cheque returned memo dated 17.08.2018 according to the plaintiff both the documents are misplaced at a time of shifting of the office. The said contention of plaintiff is supported by affidavit. The suit is proceeded ex-parte against the defandant. Hence, there is no challenged to the contention made by the plaintiff. In the circumstance, I pass following order
1. Permission granted to the plaintiff to lead secondary evidence of Cheque bearing no. 052923 drawn on state bank of India dated 22.06.2018 of Rs. 1,00,00/- in the form of its photocopies.
2. The photocopies of the cheque are placed on record along with list Exh-8. In view, of contents of evidence affidavit Exh-7 Cheque bearing no. 052923 drawn on state bank of India dated 22.06.2018 of Rs. 1,00,00 and cheque returned memo dated 17.08.2018 are marked and exhibited as Exh-13 and 14.
3. The plaintiff also placed on record the compilation of documents. The documents filed along with compilation of documents i/e true copy of resolution and ledger account supported by necessary certificate u/s 65B of Indian Evidence Act are marked and Exh- 15.
