Perused Notice of motion, affidavit in reply filed by plaintiff.
Heard both advocate at length.
The defendant has taken out the Notice of motion for condonation of delay in filing the Notice of motion on behalf of defendant in suit no. 918 of 2016.
The contention of defendant that the plaintiff has filed the suit for recovery of possession of suit premises from him. The plaintiff was absent for many dates and not taken steps, hence suit was dismissed for want of prosecution. The plaintiff has taken out the n/m for setting aside dimssisal order. But defendant could not engage advocate within time limit and failed to file reply, hence no say order passed against the defendant. The defendant has prayed that there is delay of 35 days in filing n/m, therefore delay may be condoned, no reply order passed on 31/03/2022 be set aside and defendant permitted to file reply and defend the Notice of motion filed by the plaintiff.
The plaintiff opposed the Notice of motion on ground the defendant has not given justifiable and sufficient reason to condoned the delay. The reason mentioned by the defendant are not supported by any documents evidence, hence prayed for rejection of Notice of motion.
On going through contention mentioned in Notice of motion its revels that the delay is not caused deliberately or intensionally. The defendant will not be gained in prolonging the matter. The delayed was caused for collecting documents and engaging advocate. If delay is not condoned the defendant will lose right to defendants Notice of motion on other hand. If delay is condoned no hard-ship will be caused to the plaintiff. The granted mentioned for condonation of delay are sufficient and probable.
Thus in my opinion, defendant is entiled for the relief prayed. Considering this I passed following order :-
1) Prayer clause (a), (b) and (c) of Notice of motion no. 1932 of 2022 is made absolute.
2) No say order passed against the defendant is set aside and defendant is permitted to defend Notice of motion.
3) Notice of motion no. 1932 of 2022 is disposed off.
