ORAL ORDER
1. By precipi, case is taken on board. Plaintiffs no.1 to 3
and defendant are present along with their Counsels.
2. Heard parties and their Counsels.
3. It is informed that, the plaintiffs and defendant have
amicably settled their dispute in the suit out of court and arrived at
compromise as per consent terms, which are filed on record vide
Exh.3.
4. I have verified the consent terms. Plaintiffs no.1 to 3 and
the defendant and their Counsels admit the terms of compromise.
Hence, consent terms are read and recorded.
5. As per consent terms, the parties have amicably settled
their dispute as per family arrangement, copy of which is filed with
the consent terms as Annexure-A, dated 19.8.2019. The defendant
has accepted the payment of Rs.10,00,000/- from the plaintiffs vide
clause (6) of the family arrangement and has admitted the prayer
clause (a) in lieu of the said consideration.
6. In view of the consent terms and family arrangement
between the parties, nothing survives for adjudication and suit
stands disposed of as settled by the parties.
7. Consent decree, in terms of Exh.3, shall be drawn and
consent terms as well as family arrangement dated 19.8.2019 shall
form part of the consent decree.
8. The plaintiffs shall be entitled for refund of court fees as
per rules.
Suit stands disposed of accordingly.
