Application for withdrawal filed on behalf of plaintiff.

Heard plaintiff and her counsel on Ex-2.
Yesterday, by praecipe matter was taken on board for withdrawal of
the suit. Ld. counsel for plaintiff was directed to file appropriate
application. According with this application is filed.
In view of subsequent development, fresh cause of action has arisen,
hence, plaintiff wants to withdraw the suit with permission to file a
fresh suit considering the condition made before the court
application is allowed as per following order:-
ORDER
1. Application at Ex-2 is allowed.
2. Plaintiff is allowed to withdraw the suit with permission to
file a fresh suit under order XXIII (3) (b) of CPC.
3. Plaintiff shall be entitled to refund of court fees as per rules.
4. Notice of Motion and Chamber Summons, if any, is disposed
of as infructuous. Suit be registered for statistical purpose.
Suit is disposed of as withdrawn.
Sheristedar to give authenticated copy of today's roznama to the
plaintiff.
