   This N/M is taken out by deft. praying to condone delay of 590 days in filing reply affidavit to summons for judgment taken out by plaintiff.
   It is submitted on behalf of deft. that summons for judgment was served upon deft. on 29.01.2020 and deft. was required to file reply affidavit till 08.02.2020.  Deft. was not in Mumbai from 07.02.2020 to 14.02.2020. Therefore, he could not give instructions to his advocate for the purpose of filing reply to summons for judgment within stipulated period. Thereafter, on 21.03.2020, Court passed an order to proceed matter ex-parte.
    It is further submitted that Hon\''ble Supreme Court in Suo-moto writ petition no.3/2020, extended the time for filing petitions/applications in all the proceedings with effect from 15.03.2020.  Delay in taking out this N/M is neither intentional nor deliberate. By making these submissions, deft. prayed to allow him to file reply to summons for judgment taken out by plaintiff.
     Plaintiff, by filing reply, resisted the application.  It is submitted if application is allowed, it may be allowed subject to costs.
    Considered the submissions advanced on behalf of both sides.  Record shows that plaintiff filed draft S/J on 29.01.2020 and on the same day, draft was served upon deft.  Deft. was supposed to file reply on or before 08.02.2020.  However, deft. failed to file reply within stipulated period.  Thereafter, from March 2020, matter was adjourned from time to time due to Covid-19 pandemic.  Record further shows that plaintiff has not taken the summons for judgment for the purposes of registration since 29.01.2020.  Thus, plaintiff is also not diligent in prosecuting the summons for judgment.  Therefore, it would not be just and proper to blame deft. alone for delay in hearing of the summons for judgment.  Taking into consideration the aforesaid facts and circumstances, it would be expedient to allow deft. to contest the summons for judgment taken out by plaintiff on merits.  Hence, following order.
ORDER
1.   N/M No.2278/21 is made absolute in terms of prayer clause (a) to (c).
2.    No order as to costs.
3.    N/M No.2278/21 is disposed of accordingly.
