ORDER
This Notice of Motion is filed by defendant and submitted that
the plaintiff using the name and style of M/s. Mayan Consultants and
M/s. Mayan Consultants International Conveniently. The defendant
further submitted that M/s. Mayan Consultants and M/s. Mayan
Consultants International are without any legal existence and they are
just label added on to the private residential address of the plaintiff to
mislead gullible clients. The defendant submitted that the plaintiff be
directed to produced copies of Income Tax Return and Service Tax
Return filled by plaintiff in the name M/s. Mayan Consultants and M/s.
Mayan Consultants International.

2. The said Notice of Motion strongly opposed by plaintiff. The
plaintiff submitted that the statement of defendant in the Notice of
Motion is defamatory statement. Therefore, it is necessary to take action
against defendant. The plaintiff has submitted that he is carrying on
business in the name of M/s. Mayan Consultants. Thereafter, as per
document annexureA after return in India his consultancy is known as
M/s. Mayan Consultants International. Therefore, the Notice of Motion
strongly opposed from the side of plaintiff.
3. This is the summary suit it is pending for marking of
document from the evidence of plaintiff. Thereafter, the defendant
would get opportunity to cross examined witness. Whatever defence the
defendant has raised in the Written Statement he can clarify that in the
crossexamination of the witness. At this stage before
crossexamination, it is not necessary to direct the plaintiff to file
document of Income Tax Return and Service Tax Return . Therefore,
this Notice of Motion has no substance. Accordingly, following order is
passed :

ORDER
1. Notice of motion No. 2881 of 2019 is hereby dismissed.
2. Notice of motion No. 2881 of 2019 disposed of accordingly.
