Precipe to take the suit on today\''s board is allowed.
I have gone through the roznama and it is pointed out to Adv. Gole for defendant that the defendant has not complied with the order in NM No. 1209/18 dt. 23/03/2018.
In the present suit precipe was filed on 15/03/2019 by Adv. Vandana Thakkar to issue the notice of contempt by registered AD or through Court sheriff. As the matter was fixed on 15/04/2019 the application was kept on regular date.
Now Adv. Gole for defendant who is representing the defendant has stated that the defendant wants to prefer Notice of Motion to collect donations of Ram Navmi and other reliefs.
The defendant\''s who desires to file the Notice of Motion have not complied with the court orders dt. 23/03/2018
Adv. for defendant stated that the court was vacant however on the basis of roznama the court was not vacant on 27/03/2018, 23/04/2018, 05/06/2018  when the suit was fixed.
The suit was fixed on 05/06/2018. The court was not vacant. On 27/03/2018 the suit was taken on board by ASI Gavan attached to Vinobha Bhave police station who tendered 31 photos along with panchanama. List of documents was filed by plaintiff in Nm No. 1032/18 was t.o.r. It was noted that notice was issued to the defendant why action should not be initiated for non-observing the order of court i.e. not filing undertaking. The first criteria for defendant No. 1 to 18 was to file the undertaking to the effect that if any mischiefs happened they will be responsible. The defendant instead of filing the undertaking immediately waited for one year and today also there is no such undertaking in compliance of order in NM No. 1209/18. This act on the part of Defendant No 1 to 18 shows that though defendant seeks the orders from the court but they are not complying with the conditions of the orders . Even though the court was vacant for some period but it did not prevent the deft No. 1 to 18 to file the undertaking before incharge court as the charge of this court was always kept and as such it was not vacant to comply the orders.
Therefore the defendants are hereby directed to file the NM which they desire to file before the court along with the undertaking and the report of the concerned Government architect that the structure is not in dilapidated condition.
The draft Notice of Motion is returned to Adv. Gole for defendant to comply the above direction.
Adv. for defendant is stating that he will not be able to comply the report of architect immediately.
The question of deffering will be decided in the notice of motion which defendant wants to file. However the contempt notice which is issued by my predecessor is to be complied by the defendant No. 1 to 18.
Adv. Gole for defendant stated that the notice is not served to the defendants.
The notice to the adv. on record is notice to the defendants and in case it is the statement of the Advocate that the notice is not served at the time of filing the present Notice of Motion defendant No. 1 to 18 must be present before the Court.
