Perused Chamber summons, reply and record. Heard Ld. counsel for both sides. The original plaintiff Mr. Hirachand Mehta expired on 31.12.2024 during pendancy of the suit. The plaintiff has filed copy of death certificate as Exh-A. The right to sue survives. Therefore, it is necessary to bring legal heirs of deceased plaintiff on record. The defendant has no objection for the same. The proposed plaintiffs i.e. Legal heirs of deceased plaintiff are his wife, minor son and mother. The proposed plaintiff No.1(a) being a gardian of minor sone i.e. proposed plaintiff No.1(b) is representing him as a natural gardian. If proposed amendment is allowed no prejudice would cause to the defendant.
