As per affidavit of service, the defendant has been served with the NM and relevant papers of the proceeding by speed post at the last known address of the defendant, as per the online postal track report on 10.10.2019 vide Annexure-A with the service report.
But the defendant is absent.
Heard Ld. counsel for plaintiff no. 1 to 3 on NM 3758/19 regarding grant of interim order till the NM is heard and decided on merit, in view of the urgency pressed by the counsel for the plaintiff. It is submitted that defendant is the brother of husband of plaintiff no. 1 late Shri. Bharat Jamnadas Dhara, who expired on 17.09.2012. Plaintiff no. 2 is the daughther and the plaintiff no. 3 is the son of plaintiff no. 1.
It is submitted that plaintiffs have approached this court by filing a suit for declaration and injunction and for partition in the suit property i.e. shop no. 21 admeasuring 800 sq. ft. including basement area 500 sq. ft. situated at Plot no. 422, Main Bazar, Jhulelal Marg, Mulund Colony, Mulund (W), Mumbai-400 082.
It is submitted that plaintiff had issued notice to the defendant through advocate on 04.04.2019 raising their claim in respect of the suit property. It was replied by the defendant through advocate on 20.04.2019. the defendant has denied the claim. It is alleged that defendant had given suit shop on leave and license agreement dated 22.04.2014 for a period of three years. and accepted security deposit of Rs. 300000/- from the licensee and shown less amount of license fee i.e. Rs. 14,500/- in the agreement than the market rate. Now it is apprehended that a defendant is likely to lease out the suit shop to third party and continue to deprive the plaintiff from getting their legitimate claim. Hence, the urgency for passing interim order.
After considering the oral submissions before the court and documents filed on record, I am of the opinion that till the defendant appears and filed his say on the NM it will be just and proper to pass some interim order to protect the plaintiff. Hence, I proceed to pass the following order-
Order
1. The defendant is hereby directed to maintain status quo as on today, in respect of legal status of the suit shop i.e. shop no. 21 admeasuring 800 sq. ft. including basement area 500 sq. ft. situated at Plot no. 422, Main Bazar, Jhulelal Marg, Mulund Colony, Mulund (W), Mumbai-400 082.
2. The defendant is called upon to show causes to why the NM should not be allowed by this court by confirming the interim order passed today.
3. The Ld. counsel for plaintiff is directed communicate the above order to the defendant for information and necessary compliance. Ld. counsel for plaintiff is also directed to serve the defendant with the writ of suit summons and submit affidavit of service by next date.
Sheristedare is directed to provide authenticated copy of today\''s roznama to the Ld. counsel for plaintiffs.
