and reply. Order By this Chamber summons, the plaintiff is
seeking the relief that plaintiff be allowed to strike out the
name of present plaintiff and add the new plaintiff in the
present suit. It appears that the suit is filed by the name M/s
Western Arya Transport Pvt. Ltd., a division of M/s Rhenus
Logistics India Pvt. Ltd. and now the plaintiff wants to
correct the name of it as M/s Rhenus Logistics India Pvt.
Ltd. If the plaintiff is allowed to the name of M/s Western
Arya Transport Pvt. Ltd. and to replace the name as M/s
Rhenus Logistics India Pvt. Ltd., no prejudice would cause
to the defendant. It appears that the suit is instituted on the
wrong name due to advertence by the plaintiff and it is a
bonafide mistake, it appears that for the determination of
the matter in dispute, the substitution of the name of
plaintiff is just and necessary. Hence, in view of the matter,
the Chamber Summons needs to be made absolute. In the
result, following order ORDER 1. Chamber Summons
no.1113/18 is allowed. 2. The plaintiff is directed to the
name of M/s Western Arya Transport Pvt. Ltd. and to
replace the same by name as M/s Rhenus Logistics India
Pvt. Ltd. on or before the next date, without fail. 3. Ch/s
no.1113/18 is disposed of accordingly. Matter is adjd. to
23/01/2019 for Compliance.
