It is submitted by the plaintiff that the name of original plaintiff is merged with Bank of Baroda vide Government notification dt-02.01.2019. And therefore, plaintiff seek permission to amend change name of plaintiff Bank. By way of amendment on original plaint.
Defendant filed written say and given no objection for formal amendment. I have perused Govt notification dated 02.01.2019 it shows that Dena Bank is know merged with Bank of Baroda. However, the suit is filed by the plaintiff in the name of Dena Bank and therefore, it is necessary to brought the name of Bank of Baroda on original plaint. I found that the amendment is very formal in nature and if permitted does not cause prejudice to the case of defendant moreover def has given no objection. Hence I proceeded to pass following order
ORDER
1) Plaintiff is permitted to amend the name plaintiff bank.
2) Plaintiff has directed to necessary amendment to the plaint and filed copy of plaint in the suit.
3) Chamber Summons NO. 1413 of 2019 be disposed of in above terms.
Matter adjd to 07.09.2019 for compliance.
