- 1411/19 - Perused C/S, reply filed thereto and heard both
sides. After perusal of the affidavit in support of the C/S, the
plaintiff wants to make correction in the name of defendant
no. 2 from VELAR Corporation to WELAR Corporation
and also wants to file relevant documents in support of
necessity of such correction. Ld. Adv. for defendants has
argued that the C/S is taken out only to delay the matter and
the same cannot be granted because the plaintiff had every
knowledge of the name of defendant no. 2 at the time of
filing of the suit. After going through the above submissions
and documents, the proposed amendment does not change
nature of the suit. The C/S is filed before commencement of
trial. Therefore, C/S is liable to be granted. Hence, C/S is
granted in terms of prayers clauses (a)and (b). The
amendment be carried out on or before next date and
plaintiff to serve copy of amended plaint to the defendants
on or before next date. The plaintiff to allow the defendants
to take inspection of the new documents on or before next
date. Adjd to 02-04-2020 for Compliance .
