SCHEDULE OF TRIAL DETERMINED AFTER CASE MANAGEMENT HEARING
(ORDER XVA RULE 1 OF CPC)
Heard learned counsel Rutuja Mahadik for the plaintiff and
learned counsel Chirag Mehta for the defendants on the point of case
management hearing. In this suit, issues are framed on 16/02/2021 at
Exh.9. The plaintiff filed evidence affidavits of witnesses Saloni and
Rahul at Exh.10 and 18 respectively. Similarly, the defendant filed
evidence affidavits of witnesses Surendranath as representative of
defendant no.1, Surendranath as defendant no.2 and Yerasi at Exh.19,
21 and 23 respectively. Both sides also filed tentative schedule of case
management hearing on 17/03/2021. Case management hearing is
conducted today for the completion of remaining stages in the suit in
consonance with Order XVA Rule 1 and 5 of the CPC. Following
schedule of case management is determined :
1. Evidence of the witnesses of the plaintiff to be recorded by

conducting crossexamination and reexamination – on or before
15/09/2021.
2. Evidence of the witnesses of the defendant to be recorded by
conducting crossexamination and reexamination – on or before
15/10/2021.
3. Filing of written arguments by both sides (see Order XVIII Rule 2
(3A) to (3E) of the CPC) – on or before 30/10/2021.
4. For advancing oral arguments with time limit of two hours to
either side. (see Order XVIII Rule 2 (3F) of the CPC) – on or
before 30/11/2021.
Both sides are directed to adhere time frame as far as
possible. Consequences for noncompliance with orders as per Order
XVA Rule 8 of the CPC may ensue/follow.
