The record shows that since long the matter was pending for NM hearing and after hearing the parties, the ad-interim relief on NM is refused by the Court today itself. Now, the plaintiff wants to assail this order by filing the appeal. Needless to say, that if the protection against the suit structure is not temporarily granted, and the defendant is left open to proceed against the suit structure, the very purpose of filing of this suit would fail. At the same time, there is no justifying reason to extend this protection for the period of four weeks, as is prayed. In the result, to facilitate the plaintiff to secure appropriate order from the Hon\''ble Appellate Court, the defendant is restrained to proceed against the suit structure till the next date.
At this juncture, Adv. for the defendant objected for giving the longer date. Hence, considering the ensuing the Winter Vacation, the matter is adjourned on 03/01/2022.
