Order In Chamber Summons 1386 of 2019
Chamber summons is moved by the proposed legal
heir of plaintiff no.2 . The original plaintiff Jagat
Pravinchandra Shaha expired on 19/02/2018. Ld.
Adv for the plaintiff argued that proposed plaintiff
no.2B and 2C are the son of original plaintiff no.2
and the resident of USA since last 8 years. Plaintiff
no.2A being a wife of the original plaintiff no.2 and
senior citizen not aware about the procedure for
bringing a legal heirs. Therefore there is a delay.
She requested to condone the delay and permit to
bring the legal heirs of plaintiff no.2 on record.
Adv for defendant has given no objection to bring
the legal heirs on record.
In view of the above facts following order is passed
1. Chamber Summons no. 1386 of 2019 is
hereby allowed.
2. Delay in bringing the legal heirs on record is
hereby condoned.
3. Proposed Plaintiff no.2A to 2C are permitted
to bring them as a legal heirs of Plaintiff
no.2 on record.
4. Necessary amendment be carried out
accordingly within 14 days.
