This Notice of Motion is taken out by defendant for setting
aside the order of no cross passed on 08.02.2018.
2. Defendant submitted that he was present on 08.02.2018. But
his counsel could not remain present due to his personal difficulty and
also he was engaged in Small Causes Court. He was ready for cross
examination on 05.03.2018. But no cross order came to be passed on
previous date on 08.02.2018. Hence, he prayed to setaside the order
and according to them opportunity is granted to crossexamine the
plaintiff.

3. Upon considering the hearing it appears that on the previous
date documents were exhibited and on the subsequent date no cross
order came to be passed. Thus, opportunity is granted to defendant to
crossexamine the plaintiff and for proper adjudication of the matter,
the order is setaside by imposing costs. A ccordingly, I pass the
following order.
: ORDER :
1. Notice of Motion No.2348 of 2018 is made absolute in terms
of prayer clause (b).
2. Defendant is directed to pay the cost of Rs. 2,000/ to the
plaintiff on or before next date.
