FRSR FOLLOWING ORDER IS PASSED IN NOTICE OF MOTION NO. 3175 of 2015
ORDER
1.  Notice of Motion No. 3175 of 2015 is made absolute in terms of prayer clause (b), (c) and (d).
2.  The prayer clause (a) is refused.
3.  The defendants shall deposit the arrears of royalty at the rate of Rs.15,000/- per month as per order dated 22.08.2012 in Notice of Motion No. 2351/2011 for the period from September 2012 till the date they are in possession of the suit shop. The amount already deposited by the defendants be adjusted against the arrears.
4.  The appointment of the defendants as agent of Court Receiver in respect of the suit shop as per order dated 22.08.2012 in Notice Of Motion No. 2351/2011 is cancelled and plaintiffs are hereby appointed as agents of Court Receiver.
5.  The defendants shall hand over possession of suit shop to Court Receiver within two weeks from the date of this order and thereafter Court Receiver shall put plaintiffs in possession of the suit shop.
6.  The plaintiffs shall execute agency agreement and undertakings to that effect within two weeks from putting them in possession of the suit shop as agent of the Court Receiver. They shall deposit the royalty amount of Rs.15,000/- 	per month as determined by the Court Receiver, from the date they are put in possession of the suit shop and shall continue to deposit the said amount till further order.
6.  The Court Receiver is directed to maintain the books of accounts in respect of the suit shop.
7.  The Register is directed to communicate the above order to the Court Receiver with the direction to submit the compliance report within the stipulated period.
8.  The Notice of Motion No.3175 of 2015 is disposed of.

I have heard representative of Court Receiver High Court of Bombay, Adv for plaintiff and Adv for defendants.  Read order dated 05.01.2023 passed by the Hon\''ble High Court in AO No. 10/2023.  The Hon\''ble High Court was pleased direct the parties to appear before this court on 12.01.2023.  Accordingly both the parties appeared before the court on 12.01.2023 and today made their submissions pursuant to directions given by the Hon\''ble High Court in the order.  Representative of the Court Receiver High Court of Bombay submitted that the Court Receiver be discharged without passing accounts.  Adv for plff submits that direction of the Hon\''ble High Court is only to discharge the Court Receiver High Court of Bombay and to appoint another Court Receiver.  On the other hand, Adv for defendants submits that in view of the direction given in para 3 of the order, this court will have to re-consider the order dated 23.11.2022 on NM No. 3175/2015.  After going through the order passed by the Hon\''ble High Court it is clear that the order dated 23.11.2022 on NM 3175/2015 is not set aside by the Hon\''ble High Court.  The Hon\''ble High Court has held that City Civil Court, Bombay will not have the jurisdiction to appoint Court Receiver High Court, Bombay as a Receiver and therefore, the Court Receiver appointed by this court would be required to be discharged and a fresh Court Receiver would be required to be appointed.  In the light of the above observations and directions given by the Hon\''ble High Court, the submission advanced by Ld. Adv for defendants that this court is required to reconsider the order  dated 23.11.2022 on NM No. 3175/2015 is not acceptable.  The Court Receiver, High Court Bombay requires to be discharged and the Court Receiver from this court requires to be appointed to comply with the directions given in order dated 23.11.2022 on NM No. 3175/2015.  Therefore, following order is passed.
Order
1.  The Court Receiver High Court of Bombay is discharged without passing of account.  The Court Receiver shall submit final statement of account before  the court within four weeks.
2.   Registrar City Civil Court, Bombay is directed to appoint Court Receiver in the present matter to comply with the order dated 22.08.2012 in Notice of Motion No. 2351/2011 and the subsequent order dated 23.11.2022 in Notice of Motion No. 3175/2015.
3.   The Court Receiver High Court Bombay shall hand over all the records and documents to the Receiver appointed by this court.
4.   Registrar City Civil Court, Bombay to comply the order within Four weeks.
5.  For the time being, plaintiff shall pay the charges of Court Receiver, High Court Bombay.  The amount so paid by the plaintiff be adjusted against the Loyalty amount to be paid by the plaintiff as per order dt. 23.11.2022 in NM 3175/2015.
