Adv. Gelye for plaintiff present and submitted that plaintiff has
expired on 21.04.19. He submitted that today is appearing on behalf
of proposed LR's and filing his VP on their behalf along with Draft CS
along with copy of death certificate vide anexure-A, for bringing the
LR's on record as plaintiff no. 1 (a) to 1(c) supported by affidavit.
Leave granted to register draft CS. He undertakes to serve copy on
other side.
Vakalatnama on behalf of proposed LR's of plaintiff.
Heard Ld. counsel for proposed LR's of plaintiff. None present for
defendant. It is submitted that CS may be allowed as it is filed within
limitation and facts are not disputed as defendant is real brother of
the deceased plaintiff.
In view of the above, draft CS is allowed. LR's of plaintiff be brought
on record by making necessary amendment and copy of amended
plaint be file on record within two weeks from today. CS be registered
for statistical purpose. Copy of amended plaint be served on the
other side.
