O R D E R
This chamber summons is taken out by the plaintiff for
making amendment in the plaint as well as in the notice of motion. The
defendant corporation resisted this chamber summons by filing its reply.
Read the present chamber summons of the plaintiff, affidavit of the
plaintiff in support of the chamber summons and reply of the
defendant. Heard both the learned counsels on behalf of both the sides
at length. Perused the record.
2. After hearing the argument advanced of the both the sides
at length and scrutiny by the pleading of the both the parties and on
perusal of the record, it appears to me that the suit came to be filed by

the plaintiff in the month June, 2018. In the proposed amendment
which is shown by the plaintiff in this chamber summons in schedule
that the plaintiff made an application on 24.06.2019 and the said copy
alongwith the covering letter issued by the "E" Ward, Department on
11.07.2019. Therefore, the proposed amendment is appear the
subsequent events. Therefore, if the proposed amendment is to be
allowed, then nature of the suit will not be change, moreover it will not
surprised to the defendant corporation. Therefore, I inclined to allow
this chamber summons taken out of the plaintiff. Hence, I have proceed
to pass following order.
ORDER
1. The plaintiff Chamber summons No.1346/19 for making
amendment in the plaint and NM is hereby allowed as prayed for.
2. The plaintiff and his advocate are hereby directed to carry out
proposed amendment within stipulated period.
3. Chamber summons No. 1346/19 is disposed off accordingly.
