Heard, respective advocates on Ch/s No. 1061/2018. Adv. L. K. Tripathi for plaintiff submits that the suit has been filed by the plaintiff trade union and in list of its members name of Mr. Muttu Selvan Rupnar has been shown as one of the members of the plaintiff union. However, Mr. Rupnar has already filed a suit no. 2393/2012 in this court and the same is pending and therefore, plaintiff union wants to delete his name from the list Exh. A annexed to the plaint.
The ld. Adv. for defendant strongly objected to allow the Ch/s No. 1061/2018 that both the suits the same prayer cannot be pressed by the plaintiff. Considering submissions it appears that the present suit has been filed by the trade union and in inadvertently the name of Mr. Rupnar as one of the member supporting the suit.
In view of pendency of an independent suit no. 2393/2012 filed by Mr. Rupnar the plaintiff is permitted to delete his name from the list Exh. A annexed to the plaint. Parties to bear their own costs of the Ch/s. The deletion be carried out within two weeks from today.
