Heard advocate for Defendant nos.14a and 16 for NM no.2728/19. On hearing his argument partly court has noticed that this is the NM by which the Defendant nos.14a and 16 have asked for the relief for permitting them to cross examine DW-1 after DW-1 was cross examined by Plaintiff. When this aspect was noticed by the Court, the query was raised by the Court that whether co Defendants can be permitted to cross examine DW-1 after said witness is cross examined by Plaintiff. Further, court has raised query that what should be the order of cross-examination of Defendants witnesses and when Plaintiff should come in to picture for cross-examine Defendants witness. After those queries were raised by the Court, advocate for Defendants submitted that on next date, he will reply query raised by the court and he will cite case laws in respect of those procedural queries, hence, adjourned to 13/08/2019. It is made clear that all other aspects are kept open and they will be considered after the procedural hurdle will be removed. Hence, both the parties will be given liberty to argue further if Defendant nos.14a and 16 will satisfy this court about the fact that they can cross-examine DW1 after cross-examination of said witness made by Plaintiff.
