Today, I have heard both the sides on admission and denial of documents filed on record on behalf of plaintiff at Exh. 7. It is the matter of record that defendant/MCGM denied all the documents. The plaintiff placed reliance on document filed on record along with List of documents. (Exh. 7) Therefore, as per mandate given under proviso of Sub Clause 1 of Rule 4 of Order 18 of C.P.C. It is expedient to pass order on admissibility of documents.
The document enlisted at Sr. No. 1 which consists total 7 rent receipts issued by Landlord in favour of the brother of the plaintiff. On inquiry plaintiff admitted that his brother is alive. Therefore, unless and until brother of the plaintiff is examined in this suit, the said rent receipts cannot be received in evidence. Therefore, document enlisted at Sr. No. 1 cannot be exhibited.
Document enlisted at Sr. No. 2 to 4 are the Shop and Establishment certificate, plan of the suit structure and extract of plan issued by City Survey and Land record. All these three documents are more than 30 years old. Therefore, to the extent of scope of said document as given under Section 90 of Evidence Act, there is no legal impediment to give exhibit number to said documents. Hence, Exh. 9, Exh. 10 and Exh. 11 are given to said document accordingly.
Document enlisted at Sr. No. 5 is the electricity bill in respect of ground floor of the suit structure and standing in the name of Mazahar H. Siddhqui father of plaintiff. Therefore, Exhibit No. 12 is given to said document for identification purpose.
Document enlisted at Sr. No. 6 which consists reply of Public information officer addressed to plaintiff dated 01.01.2015. Hence, Exhibit No. 13 collectively given to said reply.
Document enlisted at Sr. No. 7 is the notice dated 11.07.2014 issued to the plaintiff by defendants U/s 351 of MMC Act 1888. Said notice is not the subject matter of the present suit and therefore not the fact in issued. Hence, Exhibit No. 14 is given to said notice for identification purpose only.
Document enlisted at Sr. No. 8, 9 are the certified copies of reply submitted by the plaintiff to notice (Exh. 14) and speaking order passed by Designated officer in pursuance of the reply submitted by the plaintiff. Admittedly, notice and speaking order as stated above is not the subject matter of the present suit and therefore not the fact in issued. Hence, Exhibit No. 15 and 16 are given to said documents accordingly for identification purpose only.
Documents enlisted at Sr. No. 10 and 11 are the digital copies of Judicial Proceeding. Therefore, there is no legal impediment to give Exhibit Number to both the documents for identification purpose. Hence, Exhibit No. 17 and 18 are given to said documents accordingly for identification purpose only.
Documents enlisted at Sr. No. 12, 13 and 14 are notice dated 28.12.2015, reply given by the plaintiff to said notice dated 08.03.2016 and speaking order passed by designated officer on 06.04.2016. All these documents are fact in issues in present case. In fact, defendants ought to have admit the said documents. However, no specific reason given by the defendants in their reply as to why they are going to deny the documents. Hence, considering the facts and circumstances, I do not find any legal impediment to give exhibit number to these three documents. Hence, Exh. 19, 20 and 21 are given to said documents accordingly.
Document enlisted at Sr. No. 15 is the photocopy of letter issued by Assistant Engineer (B and F) to Law officer E ward dated 05.11.2016 along with photographs. This is the correspondence between two public servants and therefore, come within the purview of public document. Therefore, there is no legal impediment to give exhibit number to said document to the extent of copy of letter only. Hence, Exh. 22 is given to said document accordingly.
Document enlisted at Sr. No. 16, is the digital copy of judicial proceeding. Therefore, there is no legal impediment to give exhibit number to said document for identification purpose only. Hence, Exh. 23 is given to said document.
Document enlisted at Sr. No. 17, 18, 19 and 20 are copy of affidavit in reply filed by Mr. Satish Malekar, AE/Designated officer, E ward in WP No. 354/2018. Copy of speaking order dated 11.06.2018, Copy of DP Sheet and Copies of DP Sheets and assessment bills received under RTI.
Document enlisted at Sr. No. 17 and 18 are the xerox copy, whereas documents enlisted at Sr. No. 19 and 20 are private documents. Therefore, these documents cannot be exhibited at this moment. Therefore, request of plaintiff to give exhibit number to documents enlisted at Sr. No. 17 to 20 is refused.
By way of abandon caution it is clarified that giving exhibit number is administrative work of court. If any dispute arises about any of the exhibited document then it cannot be admitted in evidence unless it is proved before the court as per the mandate and manner given under the Indian Evidence Act.
