Heard both the side on C/S No.1338/19.
Plaintiff no.1 expired on 27/05/2019. Plaintiff filed instant Chamber Summons in July-2019 hence, it is within limitation. Chamber Summon is apposed by the defendant on the ground that, cause title is not correctly mention by the plaintiff. In my view, the application is within limitation and for technical reason the relief can not be denied to the plaintiff. At the most plaintiff is allowed to correct the title clause. Hence, in view of that, I proceed following order.
ORDER
1.Chamber Summons No.1338 of 2019 is made absolute in terms of prayer clause (a).
2. Plaintiff to carryout amendment as per schedule within 14 days from the date of order.
3.Plaintiff to bear cost of Chamber Summons.
4.Chamber Summons No.1338 of 2019 is disposed off accordingly.
