Ld advocate for the plaintiff submits that during pendency of the suit the suit premises is demolished by the defendants and therefore, the NM has becoming infructous. Subsequently he has filed CS for amending the plaint suitably to bring on record the facts which have taken place after institution of the plaint. Defendant nos.1 and 2 did not file reply to the said CS. In the above circumstances as the entire amendment is relating to the events which happen subsequent to the institution of the suit, the amendment is count to be allowed. Accordingly, CS no.1682/19 is allowed. Plaintiff to carry out necessary amendment within prescribed time and serve the copy of amended plaint upon the defendants as well as furnish the same before the Court. The NM no.2716/19 is not pressed by the Ld advocate for the plaintiff. Hence, it is disposed of. No order as to costs. Matter is adjd. to 24.01.2022 for framing issues.
