ORDER
Perused Chamber Summons and original Suit No. 2169 of
2017.
2. According to the plaintiff he wants to amend new address
defendant in Exh.No.1 i.e. plaint. Record shows that after filling
suit writ of summons were issued for appearance of defendant.
However, it has been returned back with report that defendant is
not residing on his address.
3. Appearance of defendant it is necessary for the settlement of
issues. Therefore, it was plaintiff to serve him legally. It is
submitted by the plaintiff that he found new address of defendant

and want to serve summons to his new address. And therefore he
wants to amend the address of defendant in Exh.No.1 i.e. plaint. I
am of the opinion that the proposed amendment is formal in
nature and if plaintiff is permitted to amend new address in Exh.
No.1. Then no prejudice will be caused to the case of other side.
Thus, I proceed to pass following order.
ORDER
1) Chamber Summons No. 1333 of 2019 is allowed.
2) Plaintiff is permitted to amend the address of defendant in
the title of plaint within 14 days.
3) Chamber Summons No.1333 of 2019 is disposed of in the
above terms.
