ORAL ORDER
This is a chamber summons submitted by the
defendant/Vodafone India Limited. It is prayed to set aside the order of
''No Cross Examination'' passed by this Court on 31.03.2018. Heard the
learned advocate Siddharth Rajmohan for defendant at sufficient
length. Perused reply submitted by plaintiff.
2. The learned advocate Dhamal for plaintiff strongly resisted
the chamber summons. It is urged that defendant is negligent and
intended to harass then employee of the company. It is claimed to
reject the chamber summons. It is material to note that in other suit,
similar order is set aside subject to costs of Rs.10,000/. On perusal of

roznama, there is substance in submission of plaintiff. The suit is of 18
years old. However, it would be appropriate to decide the suit on merit.
Hence, the order.:
FINAL ORDER
1. Chamber Summons No.1017 of 2018 is allowed.
2. The order of ''No CrossExamination'' dated 31.03.2018 is
set aside subject to costs of Rs.10,000/ be paid to the
plaintiff on or before next date i.e. 06.06.2019.
3. Chamber Summons No.1017 of 2018 disposed of
accordingly.
