O R D E R
The plaintiff has taken out the chamber summons for taking the
legal hairs of the deceased plaintiff is on record. This chamber summons
resisted on behalf of the defendant Municipal Corporation by filing its
reply. Read the present chamber summons, affidavit of the legal hairs of
the deceased plaintiff and reply of the defendant/corporation. Heard
both the learned counsels on behalf of both the sides at length. Perused
the record.
2. On scrutiny of the chamber summons and the death
certificate of the plaintiff Dr. Abdul Razak Khatri, it appears that the
plaintiff died on 14.08.2019. The applicant is the legal hairs of the
deceased plaintiff. The chamber summons taken out within period of
limitation. It will not caused any hardship, on the part of the defendant

if chamber summons is to be allowed. Therefore, I inclined to allow this
chamber summons. Hence, I have proceed to pass following order.
ORDER
1. The plaintiffs Draft Chamber summons is hereby allowed as
prayed for.
2. The plaintiff and his advocate are hereby directed to carry out
proposed amendment on or before next date.
3. Draft chamber summons is disposed of accordingly. It be register
for statistical purpose.
