defendant. Order below CH/S no. 1312/19 Perused the
CH/S which is supported by an affidavit being
executed by the trustee under the will of deceased
plaintiff. As per order dtd. 11.02.2020 the CH/S is
proceeded without reply. Heard Adv. Shri Seegarla for
the plaintiff. The copy of death certificate placed on
record shows that the plaintiff has expired on
18.04.2019. The CH/S is within limitation. The copy
of will is also placed on record showing proposed
plaintiff as the Executors and Trustees of the will. It is
submitted that the plaintiff has guide as bachelor and
the present suit will be form of estate of plaintiff.
Hence, I pass the following order. ORDER CH/S no.
1312/19 is allowed and made absolute in terms of
prayer clause (a) and (b). Applicant to carry out the
amendment within two weeks and shall serve the copy
of amended plaint upon the defendants within two
weeks thereafter. CH/S allowed and disposed of
accordingly.
