ORDER
1. The plaintiff has taken out the chamber summons for
amendment in the plaint as per order VI Rule17 of the C.P.C.
2. Perused chamber summons, affidavit in support and affidavit
in reply and suit proceedings. Heard Ld. Counsel Mohan P. Pawar for
the plaintiffs and Ld. Counsel Shri S.N. Kadam for the defendants.
3. On perusal of the record, it appears that plaintiff no.1 expired
on 02.05.2019. Therefore, present Chamber Summons is filed for
deleting name of plaintiff no.1 and for carrying out consequential
amendment. Though the defendants have opposed the chamber
summons by stating that heirship certificate is necessary, present
amendment can be allowed by relying upon affidavit in support and
death certificate of plaintiff no.1. Hence, I pass the following order:
ORDER
1. Chamber Summons No.1305/2019 is made absolute
in terms of prayer clause (a).
2. The plaintiffs are directed to carry out amendment
in the plaint within 15 days from the date of this
order.
