Deft. no.1 present. He seeks time. Already last chance was granted to deft. no.1 for hearing on Ch/
sum. Hence, plaintiff is heard on Ch/sum no.1300/19 and following order is passed.
ORDER ON CH/SUM NO.1300/19
The Ld. Counsel for the plaintiff submitted that plaintiff wishes to file certain documents which are
the statements made during the inquiry u/s.202 of the Cr.P.C. The statements were given by
plaintiff and her sisters. The plaintiff has obtained certified copies of those documents and wishes
to tender the copies of those statements. Hence, he seeks the leave of the court for the production.
The deft. no.1 has opposed the Ch/sum but has not given any cogent reason for opposing the said
Ch/sum. The matter is not cropped up for evidence. The authenticity of the documents cannot be
tested at the time of its production. Hence, the Ch/sum needs consideration and therefore, it is
expedient to pass the following order.
ORDER
1. Ch/sum no.1300/2019 is made absolute in terms of prayer clause (a).
2. The production of document is allowed subject to its admissibility in evidence.
3. Ch/sum no.1300/2019 is disposed off accordingly.
Earlier order if any to continue till next date.
The matter is adjd for hearing on N/M to 22.01.2020.
