Heard both the sides on ad interim relief.
It is brought to the notice of this court by plaintiff that plaintiff gave reply to the notice on 15.06.2018. However, the said reply is not reflected in the speaking order. Perused the speaking order. It is noted that plaintiff has not given reply. However, the copy of reply alongwith plaint do show that the reply is received by the defendant on 15.06.2018. Therefore, defendant is directed to consider the reply and documents produced by plaintiff a/w reply and then pass speaking order. Till then and thereafter, in case of adverse order if any, after two weeks defendant is directed not to take any coercive action in respect of the suit structure. Plaintiff is also directed not to make any addition and alteration of the suit structure.
1. Suit as well as Notice of Motion are disposed of.
2. Notice of Motion be registered for statistical purpose.
