O R D E R
1. The Applicant is the brother of the original plaintiff Mr. Sayyed Gulam Husain Habib who died on 21.10.2021 prayed for taking on record legal heirs of the plaintiff. Defendant No. 4, 5A, 5B and 6 opposed ch/s by filing reply. It is stated that the applicant is not legal heir of the original plaintiff. The applicant is brother of the deceased plaintiff. Original plaintiff died leaving behind him widow and children\''s as such applicant being brother of the original plaintiff can not be legal heir/ representative. Therefore defendant prayed for dismissal of Ch/s. Rest of the defendants not filed reply.
2. Heard Adv for the parties. Perused record and proceeding.
3. It is contention of defendants that the applicant brother of the original plaintiff. The original plaintiff died leaving behind him class one heir i.e. wife and son. Therefore applicant is not legal representative of the plaintiff. The present ch/s has been taken out for bringing on legal representative of the original plaintiff. As per section 2 (11) of the Civil Procedure Code legal heir means person who in the law represents estate of deceased and includes any person who intermeddles with estate of the deceased. It is the contention of the applicant that he along with original plaintiff were jointly carrying out business of suit premises. The applicant made statement on Oath that he along with original plaintiff were looking the business and after demise of original plaintiff he is in possession of notice structure. Adv. for the plaintiff submitted as per section 7 (15) of Maharashtra Rent Control Act tenant means any person by whom or on whose account rent is payable for any premises and includes, in relation to any premises when the tenant dies, any member of the tenant family who (i) when they are let for residence, is residing or (ii) when they are let for Education, Business, Trade or Storage etc any person using premises. Adv. for plaintiff submitted that applicant was doing business with original plaintiff. Therefore in view of provision of Rent Act applicant is legal representative of the original plaintiff. Honble Apex Court in the case of Jaladi Saguna through LRs V/s Satya Sai Central Trust and Others AIR 2008 SC 2866 held that the determination of the legal representative or who is legal representative under order 22 Rule 5 will be of course for the limited purpose of representation of the estate of the deceased, for adjudication of that case. Such determination for such limited purpose will not confirm on person held to be legal representative, any right to the property which is subject matter of the suit vis-a-vis other rival claimant to the estate of the deceased. Thus the purpose of determination of legal heir is for the limited purpose to represent of the estate of the deceased and it does not confer any right on such person. The applicant stated that he was doing business in suit premises with deceased plaintiff. Therefore in the view of provision of Section 7 (15) ( d) Maharashtra rent Control Act and Judgment of Hon’ble Apex Court in Jaladi Saguna (Supra) I am of the opinion that applicant is legal representative of the original plaintiff. In the circumstances, I find no substance in the contention of the defendant that applicant is not LRs of the original plaintiff in the result chs deserve to be allowed.
4. There is delay of more than 50 days for taking on record legal heirs. It is contended by Applicant original plaintiff was handling the present suit and applicant was not aware about the status of the suit and requirement of taking on record legal representative. However in the month of June 2022 Advocate sent massage to him and then he has taken out the ch/s. Therefore there is delay in filing ch/s. Thus reason given by the applicant for condonation of delay appears to be just and satisfactory. Therefore it will be just and proper to condone delay and bring on record of legal heir of original plaintiff. Hence I pass following order.
